Intellectual property‍

Kitesurfspot has the intellectual property rights to the content of this website and all the (free) products and services. This means that without express written permission, it is not allowed to use texts, images and content in whole/part for your own online platform, social media and other online channels.

Privacy Policy‍

Kitesurfspot respects the privacy of all visitors of the website www.kitesurfspot.nl,(potential) relations and (potential) customers. Personal data is therefore handled with care. This information will not be sold, traded or shared with parties that are not related to the services of Kitesurfspot.

In doing so, Kitesurfspot adheres to the requirements of the General Data Protection Regulation (AVG) in the Netherlands. This privacy statement applies when the website is visited and when products and services are used.

This means, among other things, that personal data is processed lawfully, this data is properly secured and it is shared with third parties only under conditions.

Personal data of minors‍.

Kitesurfspot does not intend to collect information from site visitors who are under the age of 16. Unless they have parental or guardian permission to do so. Unfortunately, Kitesurfspot cannot verify that a visitor is over the age of 16. Therefore, Kitesurfspot encourages parents of children under 16 to be actively involved in their children's online activities. This is to prevent collection of information about their children without parental consent. If it is suspected that Kitesurfspot has collected the personal information of a child under 16 without consent, please contact info@kitesurfspot.nl. To expedite handling, please put "Personal information of minor" in the subject line. Relevant stored information will thereby be removed from our system.

How will your data be used‍.

Data is collected and stored for the following purposes:

  • First name, last name, email address Kitesurfspot uses to send commercial mailings, newsletters, send requested free downloads, send free online documents and retargeting for Facebook ads. This is done only with the data obtained by downloading free documents, requesting free services. This is not done with data received through our contact forms.
  • First name, last name, e-mail address, company name, company address, VAT number (only for Belgian customers) and phone number are data stored when purchasing a product or service.

Kitesurfspot uses the information you provide to make the orders as fast and easy as possible. Kitesurfspot will not sell and/or provide your information to third parties. The information will only be made available to third parties if they are involved in the execution of the order.

When a payment is made for a product and/or service, this data is stored in the Viking online booking system and is also used to create a correct invoice using Moneybird, which is automatically sent to the e-mail address provided after the purchase.

Kitesurfspot always uses a secure payment environment for this purpose. The payment information is processed by our Payment Service Provider Mollie. Kitesurfspot has no access to this. The order information is also stored in Mailchimp so that the ordered products and services can be correctly processed and the correct mailings can be received. Please note that both Viking booking system, Moneybird, Mollie and Mailchimp have their own terms of use and privacy statement.

The data we store for this purpose are:

  • First and last name
    To deliver the order to the correct person
  • (Business) address, zip code and city
    We use this address for the correct delivery of your order
  • Phone Number
    Should Kitesurfspot wish to inform you of the order or provide last-minute changed information about your training/course, we will also do so by phone at certain times.
  • email address
    With each order, you will receive an email confirmation from Kitesurfspot once the order is received.
  • IP address
    The ip address is stored when the order is placed to recognize payment abuse. If a transaction starts and is not completed, the transaction data (name, address, email and IP) will be deleted from the server at the end of this month.

Sharing with third parties‍

Kitesurfspot only shares your personal information with third parties when it is necessary to perform the service (such as administration, customer service and technical support) or to comply with any legal obligation. With companies that process data on our behalf, we enter into a processing agreement that complies with the General Data Protection Regulation. This ensures Kitesurfspot the same level of security and confidentiality of the data.

VikingBookings‍

Kitesurfspot uses Viking's online booking system.

Kitesurfspot uses the information you provide to make the requested as fast and easy as possible. Kitesurfspot will not sell and/or provide your information to third parties. The information will only be made available to third parties if they are involved in the execution of the order.

Facebook‍

www.kitesurfspot.nl uses the Facebook pixel, which collects data for Facebook advertising. These are cookies for which you have also seen the cookie notice when visiting the website. For more information about cookies on the website, please refer to the cookies section of this privacy statement.

The email address, first name, phone number and behavior on the website may be shared with Facebook for the purpose of creating a custom audience for Facebook advertising. Email addresses are provided and anonymized for the creation of target groups that Kitesurfspot wants to target with the Facebook ads. Kitesurfspot then receives reports on this with anonymized data.

If advertisements are not desired to be shown via this platform, please indicate this via info@kitesurfspot.nl. It is also possible to unsubscribe from facebook for this purpose.

Note: it may be the case that kitesurfspot.com ads are still displayed after that. If so, the person is in the general target group that kitesurfspot targets its ads to.

Mailchimp‍

Kitesurfspot uses, with your permission, site tracking from Mailchimp. Sitetracking places a cookie that tracks which pages on the website are viewed. This allows Kitesurfspot to better tailor its marketing, services and advertising to customer interests. More information about sitetracking can be found here.

Mailchimp's servers are located in the United States. Data may therefore be transferred, stored and processed in the United States. The transfer of this data is done under the EU-US Privacy Shield Framework. Learn more about Mailchimp's privacy policy here.

Personal data is stored in Kitesurfspot's email system and this is through Mailchimp's servers.

Google analytics‍

Cookies are also placed by the statistics package, Google Analytics. Kitesurfspot wants to know how our visitors use the website and how many people visit the website each month, so that we can optimize the use of the website. Kitesurfspot does not want unwanted tracking, however, kitesurfspot wants to serve the customer as well as possible and that requires good statistics. With Google Analytics the information is anonymized as much as possible. The IP address is expressly not used. Kitesurfspot can therefore not trace you personally. Cookies‍

Kitesurfspot.nl makes use of cookies. A cookie is a small (text) file that a website puts on the hard disk of your computer, when you visit a website. The cookie allows your browser to be recognized on repeated visits to a website. However, a cookie does not collect personal data linked to your identity, but only remembers your preferences and interests based on surfing behavior.

Cookies are mainly placed to improve the user experience of this website.

- Functional cookies: these cookies are necessary for the correct functioning of (parts of) my website. For example, cookies from Vimeo and YouTube ensure that you can view the videos on my website.

- Marketing cookies: these cookies are used to monitor click behavior processed by the Facebook pixel and site tracking from Mailchimp which allows Kitesurfspot to better align advertising campaigns on Facebook and mailings with behavior and interest of website visitors and email list.

Kitesurfspot stores personal data no longer than strictly necessary to realize the purposes for which the data is collected. What does that mean concretely? The data which is provided to kitesurfspot so that contact can be made with the customer, will be kept until the contact has taken place. Furthermore data will be kept as long as you are a customer or relation of kitesurfspot. After that Kitesurfspot keeps the data for a maximum of 3 years after the last delivery, with the exception of invoices. We keep those for 7 years due to our legal obligations.

Affilliates & partners‍

Links are placed on kitesurfspot.com and in some emails to external websites of cooperation partners and affiliates, if kitesurfspot believes this information is valuable to the customer. Kitesurfspot has no control over how these partners handle privacy laws. It is advisable to also carefully read the privacy statement and terms of use of these partners themselves when visiting these websites.

If one has subscribed to the newsletter, requested a download, signed up for a free course, filled out a contact form or made a purchase and does not wish to receive email from Kitesurfspot in the future, there is the option to unsubscribe at any time in the link at the bottom of the email. The e-mail address will be removed from the file and will not be retained.

Retention periods‍

Kitesurfspot stores personal data no longer than strictly necessary to realize the purposes for which the data is collected. Specifically, what does that mean? The data provided to Kitesurfspot so that the customer can be contacted will be kept until the contact has taken place. Furthermore, data will be kept as long as you are a customer or relation of Kitesurfspot. After that Kitesurfspot keeps the data for a maximum of 3 years after the last delivery, with the exception of invoices. These will be kept for 7 years due to legal obligations.

Rights‍

There is always the right to withdraw consent to process the data, after which Kitesurfspot will no longer process the data. The withdrawal of this consent does not affect the lawfulness of the data statement based on your consent, which took place before this withdrawal.

There is also the right to inspect personal data and the right to rectify that personal data. If the client wants to know exactly what personal data is being processed, it is possible to submit a written request for inspection.

Should the information be incorrect, incomplete or irrelevant, Customer may request in writing that Kitesurfspot modify or supplement the information.

There is also the right to erasure of personal data, a right to restrict processing and a right to object to processing.

In addition, there is the right to transfer, or make the data transferable. This too can be requested in writing. Written also means by e-mail. The request can be emailed to info@kitesurfspot.nl.

To ensure that such a request is made by the customer, we ask the customer to send a copy of the identity document with the request. In this copy, black out the passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is for the protection of privacy. Kitesurfspot will respond to the request as quickly as possible, but within four weeks. Should Kitesurfspot not meet this deadline, we will let you know as soon as possible.
